By accessing and using PrepAmigo (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of PrepAmigo, including students, educators, and visitors to our platform.

PrepAmigo is an AI-powered test preparation platform for the CELPIP and PTE Core examinations that provides:

• Practice questions, question banks and mock exams for CELPIP and PTE Core preparation
• AI-powered scoring and feedback on speaking and writing responses
• Educational content and learning resources, including courses and study guides
• Progress tracking, practice history and performance analytics

To access certain features of PrepAmigo, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activities under your account

You agree not to use PrepAmigo to:

• Violate any applicable laws or regulations
• Share, distribute, or reproduce copyrighted content without permission
• Engage in cheating, academic dishonesty, or fraudulent activities
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without authorization
• Harass, intimidate, or harm other users

PrepAmigo offers both free and paid access, separately for each examination:

• Free access: a limited set of practice content and a daily allowance of AI-scored attempts and explanations
• CELPIP Pro: full access to the CELPIP premium features, billed weekly, monthly, quarterly or yearly
• PTE Core Pro: full access to the PTE Core premium features, billed weekly, monthly or quarterly
• A Pro subscription covers the examination it was purchased for; CELPIP Pro and PTE Core Pro are separate
• Payments are processed securely through third-party payment processors
• Subscriptions automatically renew unless cancelled
• Refunds are provided according to our refund policy

PrepAmigo and its content are protected by intellectual property laws. This includes:

• Practice questions, tests, and educational materials
• AI algorithms and scoring systems
• Software, design, and user interface elements
• Trademarks, logos, and branding materials

By submitting content to PrepAmigo (including responses, comments, and feedback), you grant us a non-exclusive license to use this content for improving our Service, providing personalized feedback, and enhancing the learning experience for all users.

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, describes how we collect, use, and protect your personal information. By using PrepAmigo, you consent to our data practices as outlined in the Privacy Policy.

PrepAmigo is provided "as is" without warranties of any kind. While we strive to provide accurate and reliable service, we cannot guarantee that the Service will meet your specific needs or that it will be error-free, secure, or continuously available.

To the fullest extent permitted by law, PrepAmigo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. You may also terminate your account at any time by contacting us or using the account settings.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Canada.
